No problem, and nothing wrong with being thorough. Certainly after the 3.3 release we could revisit this and see if others prefer slightly different font sizes.

Look in Skin/Confluence Lite/
There are folders
PAL
PAL16x9
NTSC
NTSC16x9
and inside is a Font.xml that has the fonts settings for the Skin.
these folders are using for the SD resolutions, and which one is used depends on your display settings.

Perfect, I found it and compared the differences. Looks like there are only a couple that are of a different size and the size is only one smaller. I will continue checking/testing over the weeken and/or Monday and let you know my findings. thank you for the help!

Tested on BETA Release. NTSC 4:3
It works. No more over lapping.
video is also proper width and height. Before video was too tall.
*BTW I've only had 1 crash(due to potato chip crease on DVD)

While using ntsc 4:3 the bottom of the description of each setting is cut off.

Configure Video Settings
Manage your video library- Set video playback options- Change video
listing options
---unviewable cut off text----

I found a bug in confluence lite skin bundled with XBMC4XBOX 3.3 (final release, installed just today from scratch). If you go to "Pictures" and go in any folder containing images in "Pic thumbs" view, the image preview on the right is not displayed with the right orientation (I guess it doesn't properly interpret the exif information).
In the previous stable release exif informations of my pictures weren't respected at all in all the confluence skin. I know that some work has been done on the automatic rotation using exif informations, i guess this part of the skin didn't receive that treatment

Two other bugs found:
1: While playing a movie with "Show Background "now playing" video" setting disabled (from the skin settings). If I get back to xbmc keeping the movie playing (eg i press "display" button on the remote) backgrounds are not displayed at all, all you get is a black tint.
2: In heavy playback conditions, when memory available is low, on the top of the screen "Delete of %s: xMB" is displayed. But what does %s stands for? My locale is English US and Central europe as area.

oh i see a bug. at 480p with 3.3 stable, i see:
"djust the arrow to change the amount of oversc"
hehe. but in general i don't really want smaller fonts either, so can the skin author make the boxes bigger maybe? cheers.
